before purchasing any products from xsubc electronics, llc, please carefully read
this limited warranty in its entirety. having had the opportunity to read this warranty
beforehand, if you then purchase products from xsubc electronics, llc, you
acknowledge your acceptance of, and agree to comply with, all of the following
terms and conditions:
what does this warranty cover?
when properly installed and used under normal operating conditions, xsubc electronics, llc ("xsubc") warrants all
of the products it manufacturers, that are sold as new under the xsubc name, to be free from defects in materials
and workmanship (some exclusions apply). this warranty is in lieu of any other express or implied warranty.
warranty coverage is only granted to the original retail purchaser and is non-transferable.
what is not covered by this warranty?
this warranty does not cover:
- upgrading or retrofitting a product due to changes in specifications or design;
- any costs incurred by the customer while the product is being serviced or replaced, including,
but not limited to, the cost of rental or substitute equipment;
- damage from natural causes, disasters, or accidents, including, but not limited to, power surges, lightning,
wind, fire, floods/water, or contact with any harmful or hazardous substance;
- damage to any other device(s) or equipment connected to, or used in conjunction with, the product;
- damage caused during shipping;
- normal wear and tear on the product;
- product maintenance;
- product installation, removal, and shipping costs;
- used, refurbished, or reconditioned products;
- promotional or free products;
- promotional or free products;
- any consulting or sub-contracting work performed by xsubc for other organizations or
any products resulting from that consulting or sub-contracting work; or
- items that were not manufactured by xsubc.
how long is the warranty period?
the express and implied warranty period is one (1) year from the date of purchase. the original warranty period will
not be extended with respect to any in-warranty repairs or replacements.
some states do not allow limitations on how long an implied warranty lasts, so the
above limitation may not apply to you.
what will xsubc do to correct the problem?
the only remedies available under this warranty are repair or replacement. xsubc will only repair or replace a
product after it has been shipped to, and evaluated at, its manufacturing facility in new jersey, usa. due to the
availability of replacement parts, some repairs could take six (6) weeks or more. the cost of the repair shall only
include parts and labor. product installation, removal, and shipping costs are not covered. if xsubc determines that
the product cannot be repaired, or xsubc fails to correct the same problem after three (3) attempts, xsubc will
replace it. when replacing a product, xsubc reserves the right to replace it with an xsubc factory reconditioned
product of the same model or an xsubc comparable model.
what to do to get service?
in order to have any in-warranty service performed, you must:
1) be able to provide proof-of-purchase. acceptable forms of proof-of-purchase include any unaltered, original
document (such as a receipt, bill of sale, bill of lading, packing slip, or printed email confirmation) that xsubc can
confirm, showing you as the original retail purchaser, the original date of purchase, and a description of the product
in question, sufficient enough to determine that the product being returned is in fact the one that was purchased on
the date referenced.
2) contact xsubc for a return material authorization ("rma") number before shipping anything back, and clearly
mark the rma number on the shipping label or on the outside of the packaging. the rma number helps xsubc
keep track of the product, therefore anything shipped back without an rma number could experience long delays in

3) attach a letter or note to the product detailing the problem. in case we have questions or need clarification,
please include your name and daytime phone number. if issues arise and we cannot readily contact you, there
could be a delay in processing or repairing the product.
4) package and ship the product, including all accessories, in the original container with the original packing
materials, and comply with all carrier mandated requirements (proper taping, address labeling, etc.). if you do not
have the original container or packing materials, or they were damaged, you must completely secure (using bubble
wrap or other appropriate packing materials) and double box the product and accessories, or have them
professionally packaged at your expense. shipping costs are not reimbursable. proper packaging and labeling are
essential, since xsubc is not responsible for products that are lost or damaged during shipping.
what actions will void this warranty?
this warranty shall become null and void if xsubc, in its sole opinion, determines that:
- the proof-of-purchase was altered or forged;
- the serial number on the product was defaced, altered, forged, or is missing;
- the product was damaged from abuse, misuse, or negligence, including, but not limited to, improper
installation or maintenance, operated beyond published specifications, or failure to operate it in
accordance with the owner's manual;
- the product was damaged from being connected to, or used in conjunction with, unauthorized, unqualified,
or third party devices or equipment;
- the product was operated in an unlawful manner;
- the product was repaired, modified, or otherwise altered in any way by someone other than xsubc; or
- a misleading or fraudulent service or warranty claim was filed.
are there any exclusions or liability limitations?
to the full extent allowed by law, you or any associated party agree: (1) not to hold
xsubc or any of its officers, members, executives, managers, employees, or other
representatives liable for any direct, indirect, consequential, incidental, special,
exemplary, or punitive damages, injuries, deaths, claims, or losses (actual, intangible,
economic, or otherwise) of any nature arising from any cause whatsoever, including,
but not limited to, the use or misuse of products manufactured or sold by xsubc; and
(2) that the sole and exclusive maximum liability to xsubc under this warranty shall not
exceed the original price paid for the product in question. all of this applies whether
or not xsubc or any associated parties were aware or advised of the possibility of
such losses or damages, even in the event of fault, tort, negligence,
misrepresentation, breach of warranty or contract, product or strict liability, or any
other reason, and even if any remedy fails of its essential purpose.
some states do not allow the exclusion or limitation of incidental or consequential
damages, so the above limitation or exclusion may not apply to you.
how to resolve a dispute under this warranty?
xsubc will always strive to meet customers' expectations. however, if you still are not satisfied with the outcome
after several attempts to resolve an in-warranty claim, customers are encouraged to consider resolution through
arbitration or mediation, prior to initiating a lawsuit. arbitration and mediation are typically much faster and less
costly alternatives for all parties involved, as opposed to going through the court system.
what laws govern this warranty?
the laws of the state of new jersey, and of the united states of america, shall govern all matters arising out of
or relating to this warranty. any action, suit, or other legal proceedings commenced to resolve any warranty dispute
with xsubc shall only be done so in a court of the state of new jersey or, if appropriate, a federal court located
within new jersey, and all parties involved consent to the jurisdiction of such a court. if any clause, sentence,
paragraph, section, provision, or statement contained herein is found by a court of competent jurisdiction to be
legally invalid, in whole or in part, the rest of the warranty shall remain in effect.
how does state law relate to this warranty?
this warranty gives you specific legal rights, and you may also have other rights which vary from state-to-state.
what is the effective date of this limited warranty?
the terms and conditions of this limited warranty apply to xsubc covered products purchased on or after
october 1, 2020.
